Our Role as Data Controller or Processor

In most instances, ENACUITY LIMITED acts as a data controller, determining how and why your personal data is used. However, in specific cases—such as when we process personal data on behalf of another organisation (e.g. white-label services, client portals)—we act as a data processor, and only process your personal data in accordance with that organisation’s instructions and our contractual obligations.

How Do We Use Your Data?

We only collect the personal data we need for the purposes described below.

  • Marketing communications:
    • If you’ve previously expressed interest in our products/services, we may send updates using your name and email address based on our legitimate interests. We have assessed that this processing does not override your rights and freedoms.
    • If you're a new customer and have opted in via our website, we’ll use your data to send marketing based on the preferences you’ve given us and only with your consent.

  • Events and webinars:
    When you attend events hosted by us or in collaboration with others, we collect your name, contact details and (if applicable) address. This is based on our legitimate interest in managing and promoting our events.
  • Competitions:
    We collect the personal data you submit when entering a competition (e.g. name, email). We process this under our legitimate interest to run competitions and award prizes.
  • Job applications:
    If you apply for a job, we collect your contact details, CV, qualifications, test results, references and right-to-work documentation. We process this data to assess your application, take pre-contractual steps and meet our legal obligations.
  • Business sale:
    If our business is sold, we may share personal data with the buyer under our legitimate interest in ensuring continuity of service. If you object to this, the buyer may not be able to serve you.

We store your personal data on our servers located in the UK.

  • Transfers to countries with adequacy decisions

How Long Do We Keep Your Data?
